THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE MS. JUSTICE J. UMA DEVI W.P.NO. 28908 OF 2017 ORDER: (Per Hon'ble the Acting Chief Justice Ramesh Ranganathan) The relief sought for in this writ petition is for a mandamus to declare failure of respondents 2 and 4 to take action against the 5th respondent, in terms of their letter dated 30.5.2017, as arbitrary and illegal.
By his letter dated 30.5.2017, the Environmental Engineer, Telangana State Pollution Control Board informed the Joint Chief Environmental Engineer that, on inspection of the 5th respondent-unit on 25.5.2017, it was observed that the unit was not in operation; they had not constructed Effluent Treatment Plant (ETP) to treat the effluents; and, during inspection, the representative of the unit had informed that they had registered land of Ac.3.00 guntas in Sy.No. 267/C, and one acre of land under a lease deed, but they had failed to produce the documents.
It is wholly unnecessary for us to dwell on this aspect any further, as Sri T.V. Ramana Rao, learned Standing Counsel for Telangana State Pollution Control Board, has placed before us a copy of the order dated 7.9.2017 directing closure of M/s. Himabindu Industries (5th respondent in the writ petition). It is evident therefore that, in the light of the order passed by the Telangana State Pollution
Control Board on 7.9.2017, the cause in the writ petition does not survive necessitating any further adjudication by this Court. The writ petition is, accordingly, dismissed as infructuous. Miscellaneous applications, if any pending, shall stand closed. No order as to costs.
