WRIT PETITION NO. 22993 OF 2015 O R D E R :
This writ petition is filed under Article 226 of the Constitution of India for the following relief : To declare the inaction of respondents in renewal of Arms License No.Muddanur - 16 as arbitrary, unjustified, unreasonable, unconstitutional and illegal and to pass such other suitable orders as this court may deem fit and proper in the circumstances of the case.
2. Heard Sri P. Veera Reddy, learned Senior Counsel appearing for Karri Murali Krishna, learned counsel for the petitioner and learned Government Pleader for Home and learned Government Pleader for Revenue.
3. The Collector and District Magistrate, Kadapa district, who is the second respondent vide Proceedings Ref.C3/103/M/2007, dated 26/10/2007 granted fresh arm License in favour of the petitioner herein with a permission to possess one NPB Pistol/NPB Revolver for its area of validity throughout State of Andhra Pradesh for a period of three years with validity upto 26/10/2010 for the purpose of his self-protection under section 13
of Arms Act, 1959. Subsequently, by way of Proceedings No. F.Dis C-3/138/M/11, dated 27/08/2011 the second respondent ordered renewal of the said license for a further period of three years commencing from 27/10/2010 to 26/10/2013.
4. According to the petitioner, he has submitted application for further renewal of arms license on 22/10/2013. The grievance of the petitioner herein is that even though he submitted renewal application as long back as on 22/10/2013, no action has been taken on the application submitted by the petitioner for grant of renewal by the second respondent herein.
5. In these circumstances, a request is made by the learned Senior Counsel that suitable direction may be issued to the second respondent herein to pass appropriate orders on the renewal application submitted by the petitioner.
6. Taking into consideration the totality of the circumstances and the nature of controversy, this court deems it appropriate to dispose of the writ petition with a direction to the second respondent to pass appropriate orders on the renewal application by fixing some time frame.
7. For the aforesaid reasons, the writ petition is disposed of,
directing the Collector and District Magistrate, YSR Kadapa district at Kadapa to pass appropriate orders in accordance with law on the application dated 22/10/2013 submitted by the petitioner herein for grant of renewal of licence within a period of three months from the date of receipt of a copy of this order. No costs.
8. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
