HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.31349 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 3rd respondent-Sub Registrar, in not receiving and processing the Gift Deed pertaining to land admeasuring Ac.4.20 gts, situated at Sy.No.59 of Kerelly Village, Dharur Mandal, Vikarabad District, submitted by the petitioner herein for registration, as illegal and arbitrary.

The grievance of the petitioner is that he is the lawful owner and possessor of the above said land as the same was inherited from his father. The name of the petitioner was also recorded in the revenue records, and pattadar passbooks and title deeds were also issued in his favour. While things stood thus, the petitioner wants to execute a gift deed in favour of his son in respect of the part of the subject property, approached the 3rd respondent-Sub Registrar, for registration by paying the requisite stamp duty, but the 3rd respondent, orally refused to receive the same, without assigning any reasons. Challenging the same, the present writ petition, came to be filed.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 3rd respondent-Sub Registrar, to receive and process the Gift Deed of the petitioner for registration, if it is in accordance with the law. If the 3rd respondent-Sub Registrar, is not intending to register the document presented by the petitioner for registration, the 3rd respondent-Sub Registrar, shall return the same assigning reasons, as early as possible, preferably within a period of two to four weeks from today, by giving reasonable opportunity of hearing to the petitioner and all the concerned.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
