The revision petitioner who is the husband of the 2nd respondent has filed the present revision petition questioning the order of the learned Judge, Family Court-Cum-III Additional District Judge, Warangal passed in MC.No.20 of 2007, dated 20.01.2010, in granting maintenance of Rs.1500/- per month to the 2nd respondent.

This Court on 16.04.2010 ordered as follows:
"There shall be interim stay of 1/3rd of the maintenance amount awarded and the petitionerhusband shall pay all the arrears at the rate indicate above and shall continue to pay at the same rate, until further orders.
Respondent No.2-wife can withdraw the amount as and when deposited. In fact, the amount shall be deposited in the Savings Bank Account of respondent No.2, which has to be obtained through her counsel"

Heard learned counsel for the revision petitioner and learned Additional Public Prosecutor for the respondent - State. Perused the record.

Learned counsel appearing for the revision petitioner would submit that the petitioner has no means of income and he is staying with his parents.

At this length of time, this Court is not inclined to interfere with the order of the learned Judge, Family Court-cum-III Additional District Judge, Warangal passed in MC.No.20 of 2007, dated 20.01.2010.

Accordingly, the Criminal Revision Case is dismissed. Since the application is made under Section 125 of Cr.P.C., the 2nd respondent is at liberty to move the concerned Court seeking any alteration in the maintenance by filing an application under Section 126 of Cr.P.C.
