HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION Nos.30860 and 30893 OF 2017 COMMON ORDER:
The inaction of respondent No.1 in disposing of the revision petitions dated 29.07.2017, including stay petitions, filed by the petitioners against the order dated 19.06.2017 passed in CMA.Nos.43 and 44 of 2007 on the file of Additional Agent to Government, Bhadrachalam, Khammam, is questioned in the Writ Petitions as being illegal and arbitrary. Though various grounds are raised, learned counsel for the petitioners restricts his prayer seeking a direction to the revisional authority to dispose of the main revisions or the stay applications filed by the petitioners at the earliest. Having regard to the fact that the petitioners are in possession of the land in dispute and, apprehending eviction, they plead stay of the impugned order dated 19.06.2017.
The same is opposed by the learned Government Pleader for Social Welfare but, however, states that respondent - authorities may be directed to dispose of the stay applications or the main revisions, in accordance with law at the earliest. Having regard to the statements made across the Bar, the Writ Petitions are disposed of directing the revisional authority to dispose of the revision petitions filed against the order dated 19.06.2017 passed in CMA.Nos.
2007 by the Additional Agent to Government, Bhadrachalam, Khammam, as early as possible preferably within a period of eight weeks from the date of receipt of a copy of the order. Till such time, status quo obtaining as on today with regard to possession shall be maintained. It is made clear that the revisional authority shall make a speaking and reasoned order after giving due opportunity to the parties involved, as otherwise, the same would be liable to be set aside for failure to do so which would defeat the very exercise done. Consequently, the miscellaneous applications, if any, shall stand closed.
