HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 22638 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer of shop No.48, Korapuram Village, Amadalavalasa Mandal, Srikakulam District. Certain complaints were lodged against the petitioner in pursuance of which a show cause notice was issued to him. The authorization of the petitioner was suspended on 14.11.2012 and the petitioner submitted his explanation on 12.02.2015. After due enquiry, the fourth respondent passed the impugned order on 15.06.2015 cancelling the authorization of the petitioner. Against the said order, the petitioner preferred an appeal to the third respondent on 02.07.2015. Since the said appeal has not been disposed of, the petitioner approached this Court by way of the present Writ Petition.

A perusal of the impugned order indicates that it was passed after giving due opportunity to the petitioner. In view of pendency of appeal, this Court is not inclined to go into the merits of the case at this stage. However, the third respondent is directed to consider the appeal filed by the petitioner on 02.07.2015, against the order of the fourth respondent dated 15.06.2015, after giving due opportunity to the petitioner, and pass final orders, within a period of sixty days from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition
