THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.16996 OF 2016 ORDER:

Heard both sides and with consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage.

2. The present Writ Petition is filed seeking issuance of writ of mandamus declaring the action of respondents 3 to 5 in not taking any action on the representation dated 17.05.2016 submitted by the petitioners and others objecting to grant permission to the 8th respondent to run the school in the premises of respondents 6 and 7 bearing H.No.7-7-59 and 7-7-59/1 (Part) situated near Collectorate Chowk, Vidyanagar Colony, Adilabad Town and District though the 5th respondent Municipality granted permission for construction of residential house in ground and first floors only as illegal and arbitrary and consequently, to direct respondents 3 to 5 not to grant any permission to respondent No.8 to run the school in the above mentioned house premises, which are constructed in deviation to the approved plan by further directing respondent No.5 to take necessary legal action against illegal constructions made by respondents 6 and 7.

3. Learned counsel for the petitioner filed photographs showing the alleged constructions. He also strongly relies on the building plan, which has been approved and also the constructions made in violation of the building permission.

4. Though various grounds are raised in the writ petition,

learned counsel for the petitioners restricts his prayer seeking a direction to the respondents to consider the representation made by the petitioners at the earliest.

5. Having regard to the circumstances stated above and without going into the merits of the case, the Writ Petition is disposed of directing respondents 3 to 5 to consider the representation dated 17.05.2016 and pass appropriate orders thereon, in accordance with law, as early as possible preferably within a period of two (02) months from the date of receipt of a copy of this order.

Since this Court has not gone into the merits, notice to the unofficial respondents may not be necessary.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
