This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue writ of mandamus to declare the action of the 3rd respondent in directing the Inspecting Officials to seize stock pertaining to 495 bags declared as PDS Rice without being certified by Competent Authority is as illegal, improper and arbitrary and without jurisdiction and consequently to release the stock pending disposal of Sec.6-A enquiry."
Heard, Ms.Lakshmi Priyanvita Popuri, learned counsel for the petitioner and learned Government Pleader for Civil Supplies for respondents.
Petitioner herein, which is a rice mill, filed a petition before the Joint Collector, Kurnool on 07-01-2017 for release of seized stock of 495 bags of rice. The grievance of the petitioner as submitted by learned counsel for the petitioner is that no orders on the said application have been passed so far and the respondents are trying to distribute the seized stock.
Learned Government Pleader for Civil Supplies submits that enquiry is pending.
Having regard to the nature of controversy and keeping in view the the pendency of application before the Joint Collector, this Court is of the considered opinion that the ends of justice would be served if the Joint Collector is directed to pass appropriate orders on the said application by fixing some time frame.
For the aforesaid reasons, the writ petition is disposed of, directing the Joint Collector, Kurnool - 2nd respondent herein to pass appropriate orders, in accordance with law, on the representation, dated 07-01-2017 said to have been submitted by petitioner, within a period of one month from the date of receipt of a copy of this order. Till then, the seized stock shall not be distributed.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
