The Court made the following:
ORDER:
This Writ Petition is filed for the following relief : " ... to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus to declare the action of respondent No.3 in the proposing to replace the petitioner Masjid Development Committee with a new Masjid Construction Committee in the name and style of AFJAM Construction Committee as illegal and unconstitutional ..."
As this Court was not inclined to entertain this Writ Petition on the view that the same is premature, Mr. Prabhakar Sripada, learned Counsel for the petitioner, requested for an adjournment on 3-12-2015. Accordingly, the case has been adjourned. Today, at the hearing, the learned Counsel for the petitioner submitted that as per his information no immediate action is likely to be taken by respondent No.3 for appointment of respondent No.5 for respondent No.4-Wakf. He has accordingly requested for closing the Writ Petition with liberty to his client to avail appropriate remedy as and when any decision adverse to its interests is taken.
In the light of the above submissions of the learned
Counsel for the petitioner, the Writ Petition is closed, with liberty to the petitioner in terms of the prayer made. As a sequel to the disposal of the Writ Petition, WPMP No.50715 of 2015 filed for interim relief is disposed of as infructuous.
