THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.34768 OF 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies.
The primary grievance of the petitioner is that though she has filed an appeal along with the stay petition on 07.10.2015 before the Joint Collector, Mahaboobnagar District, the 2nd respondent, against the order of cancellation of her authorisation, dated 22.09.2015, neither the appeal nor the stay petition has been taken up and in the meanwhile the petitioner is deprived of her source of livelihood, namely, the Fair Price Shop.
It is evident that against the impugned order, dated 22.09.2015, the petitioner has preferred the appeal on various grounds and has placed strong reliance upon earlier order of the 2nd respondent in Case No.CS6/53/2014, dated 22.10.2014. However, I am not inclined to entertain the Writ Petition and go into the contentions of the learned counsel for the petitioner as the appeal filed by the petitioner is pending before the 2nd respondent and the petitioner is at liberty to raise all her contentions in the said appeal.
In the circumstances, the Writ Petition is, therefore, disposed of directing the 2nd respondent to fix an early date for hearing of the appeal and the stay petition filed by her, as referred to above, and pass appropriate orders atleast to the extent of
the stay petition, preferably within a period of one week from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
