This Transfer Civil Miscellaneous Petition, under Section 24 of CPC, is filed to withdraw FCOP No.46 of 2016 pending on the file of Family Court, Anantapur to Family Court, Kurnool, Kurnool District, on various grounds.

During hearing, learned counsel for the petitioners requested this Court to dispense with the presence of the petitioner on every day of adjournment in connection with FCOP No.46 of 2016 before the Judge, Family Court, Anantapur.

No doubt, it is difficult for the petitioner being a lady to undertake journey on every date of adjournment, but her presence on every day of adjournment is not necessary as the proceedings in FCOP are governed by Civil Procedure and therefore, at best, she requires to appear only on few occasions, for recording their evidence, but not on all days. Therefore, the learned Judge, Family Court, Anantapur, is requested not to insist her presence on every date of adjournment, except on the dates her presence is required to record cross examination or for any other purpose.

With the above direction, this Transfer Civil Miscellaneous Petition is dismissed. As a sequel, miscellaneous applications pending, if any, shall stand closed.
