THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.24350 OF 2016 ORDER:
Vide the present petition, the petitioner seeking mandamus to declare the action of the respondents in not implementing the proceedings in MCR No.11/791/2014, dated 30.10.2014, as arbitrary and illegal and consequently, direct the 2nd respondent to implement the aforesaid proceedings forthwith and put the petitioner society in possession of Ac.2-00 of land allotted to it near STP (Sewage Treatment Plant) Rajahmundry.
2. Learned counsel appearing on behalf of the petitioner submits that for the aforesaid relief, the petitioner made a representation on 30.05.2016 to respondent Nos.2 and 3, but, till date there is no response from them.
3. On the other hand, learned Standing Counsel for respondent No.3 assured this Court that the representation, dated 30.05.2016, filed by the petitioner shall be decided within four (04) weeks from today.
4. In view of submission made by learned Standing Counsel for respondent No.3, nothing survives in the writ petition and the same is accordingly, disposed of. Needless to state that if the petitioner is still aggrieved by the action or inaction of respondent No.3, he may approach appropriate Forum. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
