2019-08-30P.Keshava Rao2 pages

HONOURABLE SRI JUSTICE P.KESHAVA RAO W.P.No.525 of 2014 ORDER:

The prayer sought in this Writ Petition is as under: "... to issue an appropriate writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in interfering with the petitioner's cable service namely SS Digital and Datacom Service Private Limited, Nirmal, Adilabad District, as illegal, arbitrary, violation of Fundamental Rights guaranteed under the Constitution of India and without Jurisdiction and consequently direct the respondents not to interfere with the petitioner's day to day cable service namely SS Digital and Datacom Service Pvt Ltd Nirmal Adilabad District." Heard learned counsel for the petitioner.

During the course of hearing, the Government Pleader for Home placed before this Court the written instructions, dated 29.8.2019, submitted by the Sub-Inspector of Police, Nirmal Town Police Station, Nirmal District.

A perusal of the said written instructions would reveal that the petitioner is involved in five crimes for various offences. As far as the allegation of the petitioner that the respondent Police are interfering with the petitioner's cable services, viz., S.S.Digital and Datacom Service Private Limited, is concerned, the same is categorically denied by the respondent Police in the written instructions. Further, it is specifically stated that the respondent Police did not harass, threaten or interfere with the lawful business of the petitioner at any point of time. The copy of the said written instructions is made part of the record.

Taking into consideration the above said facts, this Court is of the opinion that no further cause would survive for adjudication in the Writ Petition.

Accordingly, the Writ Petition is closed.

As a sequel, the Miscellaneous Petitions pending, if any, shall also stand dismissed. No order as to costs.
