This criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in Crime No.60 of 2015 of Nandaluru Police Station, registered for the offences punishable under Sections 498-A, 307 read with 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act, on various grounds.
The Sub-Divisional Police Officer, Rajampet, YSR District, Kadapa, filed memo before the Court below informing that Section 307 IPC is deleted as per R.C.No.07/SDPO-RJPT/17, dated 10.02.2017 and now the proceedings are pending against the petitioners are only for the offences punishable under Section498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act.
It is brought to the notice of the Court during hearing that the de facto complainant and A1 to A6 appeared before the Court below on 11.02.2017 and sought permission to compound the offences referred supra and accordingly, the Court below permitted them to compound the offences referred supra while keeping under observation for a period of three months for final settlement and posted to 11.05.2016. In terms of the permission granted by the Court below, the 2nd respondent and A1 living separately, but the Court below did not take any further action and adjourned the matter on account of absence of the parties. Therefore, the Court below is directed to issue summons to both parties to appear before the Court below to find out whether they are ready to compound the offences or not in terms of the direction issued by the Court below on 11.02.2017 and dispose of the application as expeditiously as possible, in
any event not later than one months from the date of receipt of a copy of the order.
With the above direction, the criminal petition is disposed of. However, in case, the parties did not agree for compounding the offences after completion of observation period of three months, the petitioners are at liberty to approach this Court and renew their request by appropriate application.
Pending miscellaneous petitions in the petition, if any, shall stand closed.
