THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.41509 of 2015 ORDER :

The petitioner herein challenges the impugned proceedings dt.15.12.2015 of the 2nd respondent, suspending his Fair Price Shop dealership authorization. 2.

A show-cause notice has been issued on 02.12.2015 making five charges against the petitioner.

Although the counsel for petitioner alleges that the charges are mala fide, inasmuch as petitioner had earlier approached this Court questioning the action of the respondents, and in order dt.08.07.2015 in WP.No.20891 of 2015 liberty was given to respondents to initiate proceedings if need be, I am not inclined to go into the said issue.

The petitioner is granted two (02) weeks' time to file his explanation to the charges made against him in the show-cause notice dt.02.12.2015, and the 2nd respondent is directed to conduct enquiry into the allegations of petitioner within a period of three (03) months from the date of receipt of a copy of the explanation of petitioner after complying with the principles of natural justice, and providing a personal hearing to petitioner.

5. It is also made clear that if the petitioner does not

submit his explanation within the time specified above, it is open to 2nd respondent to proceed ex parte.

Accordingly, the Writ Petition is disposed of with the above directions. No order as to costs. 7.
