Aggrieved by the action of the 3rd respondent in not proceeding with the investigation in Cr.No.1274 of 2008, this Writ Petition is filed.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for respondents 1 to 3.
Learned counsel for the petitioner submits that though Cr.No.1274 of 2008 is pending since long time, the 3rd respondent police is not proceeding with the investigation and filing charge sheet against 4th respondent.
Learned Assistant Government Pleader for Home appearing for respondents to produced written instructions dated 04.09.2018 stating that Charge sheet vide SR No.8667/2018 is filed before the III Addl. Chief Metropolitan Magistrate at Nampally.
A perusal of the written instructions filed by the learned Assistant Government Pleader for Home goes to show that though Crime No.1274 of 2008 is registered in the year 2008, after filing of the present Writ Petition, charge sheet is filed, which is against the spirit of Section 173 (1) of Cr.P.C, which states that investigation should be completed as expeditiously as possible.
In view of above, this Writ Petition is disposed of directing the respondents 1 to 3 to see that the charge sheet vide SR No.8667 of 2018 before the III Addl. Chief Metropolitan Magistrate at Nampally, be numbered as expeditiously as possible, preferably within a period of two weeks from the date of receipt of a copy of this order. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stand closed. _______________________________ A.RAJASHEKER REDDY, J 06-09-2018.
