THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.37960 of 2014 ORDER:

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue (A.P.) for respondents. The case of the petitioner is that he purchased an extent of Ac.2.52 cents of land situated in Sy.Nos.123/1B, 124/2, 124/1, 125/4, 123/1A, 124/1, 125/3 of Rebala Village, Buchireddypalem Mandal, SPSR Nellore District, under Registered sale deed vide document No.474/1993, dated 7.07.1993. On account of the dispute that has been raised by the neighbours with respect to the boundaries, to have clarity and certainty the petitioner submitted a representation by paying requisite fee to the 5th respondent for appointment of surveyor to inspect and measure the land and fix the boundaries. Accordingly the 5th respondent appointed the 6th respondent to inspect and measure the land. The 6th respondent issued notice dated 20.04.

2013 to the petitioner and to one Tammireddy Kistaiah to attend the disputed land on 22.04.2013, but he failed to conduct enquiry. The main grievance of the petitioner is that though he had approached the 5th and 6th respondents several times they have not taken any action to get the survey done. Hence the present writ petition. The learned Government Pleader on instructions submits that the 6th respondent had fixed the date as 10.01.2015 for conducting survey, but the petitioner did not attend on account of his Sabarimalai trip and at his request the survey was postponed. However, 24.01.2015 has been fixed for conducting survey. Recording the said submission, the writ petition is disposed of with a direction that the respondent-authorities shall make all efforts to complete the survey on 24.01.
