THE HONOURABLE SRI JUSTICE M.S.K.JAISWAL Crl.P.No.4449 of 2015

ORDER

This petition under Section 482 Cr.P.C., is filed by the petitioner against the order dated 11.02.2015 passed in M.P.No.75 of 2014 in O.P.No.1468 of 2012 on the file of the Judge, Family Court-cum-V Additional District and Sessions Judge, Visakhapatnam.

2. The respondents herein, who are the wife and son of petitioner, filed O.P.No.1468 of 2012 seeking to grant maintenance from the petitioner. They also filed M.P.No.75 of 2014 for interim maintenance. The trial Court, after considering the material on record, directed the petitioner herein to pay a sum of Rs.3,000/-per month to the first respondent-wife and Rs.2,000/-per month to the second respondent-son towards interim maintenance. Challenging the same, the petitioner filed the present criminal petition.

3. Having regard to the facts and circumstances of the case, the interim maintenance awarded by the trial Court to the respondents herein does not appear to be excessive. Hence, there are no grounds to interfere with the impugned order. However, the trial Court is directed to dispose of O.P.No.1468 of 2012 as expeditiously as possible, preferably within three months from the date of receipt of a copy of this order.

4. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand closed. ________________ M.S.K.JAISWAL, J 12th June, 2015
