THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON No.31360 OF 2018 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) Order dated 16.08.2018 passed by the Andhra Pradesh Administrative Tribunal (hereinafter, 'the Tribunal'), Hyderabad, dismissing O.A.No.1654 of 2018 is subjected to challenge by the applicant therein. Sri Rangarajula Rajasekhar Rao, learned counsel representing Sri R.V.Mallikarjuna Rao, learned counsel for the petitioner-applicant, and the learned Government Pleader for Services, State of Andhra Pradesh, fairly concede that the issue arising for consideration in this writ petition is squarely covered by the order dated 21.08.2018 passed by this Court in W.P.No.28886 of 2018.

For reasons alike as were stated in the aforestated order and in terms thereof, the writ petition is allowed setting aside the order dated 16.08.2018 passed by the Tribunal in O.A.No.1654 of 2018. There shall be a consequential direction to the authorities to consider the case of the petitioner-applicant for promotion to the post of Excise Superintendent as and when such promotions are taken up in accordance with the provisions of G.O.Ms.No.257, General Administration (Ser-C) Department, dated 10.06.1999.
