HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.22459 OF 2011 ORDER:

Writ Petition is filed with the allegations that the petitioners are sought to be evicted from their land in possession over an extent of Ac.0-14 cents situated in Sy.No.1182 of Badvel Town, Kadapa District.

This Writ Petition was admitted on 09.08.2011 and interim order came to be passed in W.P.M.P.No.27407 of 2011 is as follows:

"Pending further orders, the petitioners herein shall not be evicted from the plots in question nor shall their houses be demolished, except after putting them on notice and taking action thereafter in accordance with law. It is made clear that the petitioners shall also not resort to further construction over the said land nor shall they alienate or create third party rights over the land in question."

Even as on today, there is no counter affidavit filed denying the allegations made by the petitioners. In that view of the matter, interest of justice would be served by disposing of the Writ Petition with a direction that the petitioners herein shall not be evicted from the plots in question nor shall their houses be demolished except after putting them on notice and taking action thereafter in accordance with law.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, shall also stand dismissed.
