HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.34885 of 2015 ORDER:

This Writ Petition is filed by Ex-President and a Member of the Valaparla Primary Agricultural Cooperative Society (fourth respondent - Society), whose elected term came to an abrupt end due to disputes among the members of the managing committee and no quorum was formed to conduct meetings. In those circumstances, an official person-in-charge was initially appointed on 31.10.2013, under Section 32(7)(a) of the A.P.Cooperative Societies Act, 1964, to manage the affairs of the society for a period of six months from 01.10.2013 and the said term was extended from time to time.

Learned Government Pleader for Cooperation brought to the notice of this Court G.O.Rt.No.509 dated 30.06.2015 whereunder the term of non-official person-in-charge committee which expired on 02.03.2015, was extended from 03.03.2015 to 02.09.2015.

Though the present Writ Petition is filed challenging the appointment of non-official person-in-charge committee on 02.09.2014, which term already expired, learned counsel for the petitioners submits that, in view of repeated extensions granted to the person-in-charge, it is proper to conduct elections to the fourth respondent - Society at the earliest point of time. Since the societies have to be run on democratic lines, an elected body is imperative. There were bickerings in Society which resulted in appointment of person-in-charge which has been continuing since 01.10.2013. It is not proper to continue

the appointment of person-in-charge for long periods. In the circumstances, respondent Nos.2 and 3 are directed to take necessary steps to conduct elections to the fourth respondent - Society, and complete the same, in accordance with the provisions of the A.P.Cooperative Societies Act before the end of the present term of the person-in-charge committee i.e. 02.09.2015.

The Writ Petition is, accordingly, disposed of. As a sequel thereto, miscellaneous applications, if any, also stand disposed of. No order as to costs. _______________________________ A. RAMALINGESWARA RAO,J Date:08.07.2015 usd
