ORDER

This contempt case is filed complaining willful disobedience on the part of the respondent in implementing the orders passed by this Court in WP No.25863 of 2015, dated 18.08.2015.

Heard learned counsel appearing for the petitioner. Pursuant to the order passed by this Court, the respondent-Project Director examined the issue and issued an endorsement dated 31.08.2015 stating that his enquiries revealed that the petitioner was involved in an offence punishable under Section 302 IPC of Lepakshi Police Station and was arrayed as A1 in the said case. It is stated in the endorsement that taking back the petitioner to duties will be subject to result of the case. Since the respondent-Project Director issued the endorsement after examining the issue, I do not see that any contempt is made out against the respondent.

Therefore, the Contempt Case is closed. However, the petitioner is at liberty to challenge the endorsement at appropriate writ or other proceedings.
