THE HON'BLE SRI JUSTICE SANJAY KUMAR Contempt Case No.1128 of 2015 ORDER:

This contempt case was instituted alleging wilful disobedience to the order dated 25.03.2013 passed by this Court in W.P.M.P.No.10342 of 2013 in W.P.No.8273 of 2013. By the said order, this Court recorded the statement made by the learned Standing Counsel for the Andhra Pradesh Wakf Board that his client was ready to implement its resolution dated 24.12.2012 whereby the petitioner had been appointed as the Mutawali of the subject Wakf institution.

However, it appears that on 15.04.2013, another order was passed by this Court in the very same miscellaneous petition. By that order, this Court took note of the fact that a criminal case had been lodged against the petitioner in the writ petition and opined that the resolution of the Wakf Board appointing the petitioner as Mutawali of the institution required further consideration and could not be acted upon in the meanwhile. The Andhra Pradesh Wakf Board was accordingly directed to maintain status quo insofar as the said Wakf institution was concerned pending further orders. In the light of the order dated 15.04.2013 passed subsequently in W.P.M.P.No.10342 of 2013 in W.P.No.8273 of 2013, the earlier order dated 25.03.2013 recording the undertaking of the learned counsel of the Andhra Pradesh State Wakf Board stood nullified. Therefore, the question of any disobedience to the earlier order does not arise.

The contempt case is misconceived and is accordingly dismissed. No order as to costs.
