THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 38071 of 2015 ORDER:

This writ petition was filed alleging inaction on the part of the police authorities in proceeding with the investigation in Crime No.424 of 2014 on the file of the Kukatpally Police Station, Cyberabad, Hyderabad.

2. Written instructions dated 07.01.2016 were furnished by the SubInspector of Police, Kukatpally Police Station, to the office of the learned Government Pleader for Home wherein he stated that Crime No.424 of 2014 had been registered under Sections 406, 420 and 506 IPC upon the private complaint filed by the petitioner being forwarded under Section 156(3) Cr.P.C. by the learned IX Metropolitan Magistrate, Cyberabad at Kukatpally. However upon investigation the police authorities found that the necessary ingredients for making out offences under the named provisions were not made out and accordingly filed a final report before the learned IX Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad, on 05.01.2016 vide Inward No.45/16 referring the case as 'civil in nature'.

3. In the light of the aforestated developments, it is for the petitioner to take recourse to appropriate remedies in accordance with law if he is aggrieved by the conclusion arrived at by the police authorities. Reserving liberty to the petitioner to do so, the Writ Petition is closed. Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to costs.
