HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.394 of 2014

ORDER:

The grievance of the petitioner necessitating institution of the writ petition was that acquisition was not equivalent on either side of the road and excess acquisition was resorted on the side of the road where property of the petitioner is lying. This Court by order dated 17.02.2014 granted order of status quo obtaining as on that day. Alleging that said order is violated, this Contempt Case is filed.

2. It is contended that as per the photographs enclosed to the Contempt Case, the authorities were taking markings on the road after order of status quo was passed by this Court and they have violated the orders of this Court.

3. Counter-affidavits are filed by the respondents 1, 2 and 3. In the counter-affidavit filed by the 1st respondent, it is categorically asserted in para-3 of the counter affidavit that no part of the petitioner's land situated in Survey No.710 of Jangaon Village, Ramagundam Mandal, Karimnagar District, was taken over for formation of four lane road and that he categorically denied the allegation of the petitioner that the respondent did not maintain status quo as per the orders of this Court and made markings on the property of the petitioner.

4. In view of the categorical statement of the first respondent, the allegation that the orders of this Court are violated is not correct. Accordingly, Contempt Case is closed. Miscellaneous petitions pending, if any, in this case shall stand closed. __________________________ JUSTICE P.NAVEEN RAO Date : 23.01.2015 kkm
