THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14648 of 2024 ORDER:
Seeking the Court to enlarge the petitioner who is arrayed as accused No.12 in Crime No.168 of 2024 of Karimnagar I-Town Police Station, Karimnagar District, on bail, the present Criminal Petition is filed. 2.
The brief facts of the case are that on 05.11.2022, an incident occurred at Bhagathnagar, Karimnagar, which was reported on 14.03.2024, by the complainant, Chinthalapalli Kamalakar. The complainant alleged that accused No.1, Ganta Anil Kumar, and accused No.2-Ganta Sunil took Rs.2,95,000/- from him, promising to secure a visa and job in Europe, but failed to do so.
Similarly, they took Rs.3,18,000/- from Komalla Sunil Kumar for the same purpose. When the complainant demanded a refund, the accused refused, thereby cheating him.

Heard Sri Y. Soma Srinath Reddy, learned counsel representing M/s. harsheet Reddy Law Firm, appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon,
learned Additional Public Prosecutor appearing on behalf of the respondent.

Learned counsel for the petitioner submitted that the case of the prosecution is baseless and that there is no evidence against him. He was arrested on 05.11.2024, and has since been remanded to judicial custody. He further submitted that the petitioner denies any involvement in the alleged job visa fraud and asserts that he had no knowledge of the principal illegal activities of the accused and that the investigation is completed, and the petitioner's continued detention is unnecessary. He further submitted that the petitioner assures the Court that he will abide by any conditions imposed if granted bail and undertakes to furnish sureties. The petitioner had earlier filed a bail petition, which was dismissed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition. 5.
On the other hand, learned Additional Public Prosecutor submitted that some of the amount is also deposited into the account of the petitioner on 21.10.2023 and 27.10.2023 and she is also the employee of the said company. He further submitted that the investigation is not yet completed, as such,
granting of bail at this stage, does not arise and prayed the Court to dismiss the criminal petition.

After considering the submissions made by both the learned counsel and reviewing the material available record, it is to be noted that the Investigating Officer has examined 15 witnesses, all of whom are victims, and none have mentioned the name of the petitioner in connection with the alleged offence. As the petitioner is in jail from 05.11.2024, and a significant part of the investigation is complete, this Court deems it fit to grant bail to the petitioner with the following conditions:
i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned VI Additional Chief Metropolitan Magistrate, Nampally, Hyderabad.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
