THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.14262 of 2025 ORDER:

This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.13 in Crime No.189 of 2025 before the Prohibition and Excise Police Station, Huzurabad.

The brief facts of the case are that the ST Hyderabad Team and Prohibition & Excise Station, Huzurnagar Team conducted a raid at a house in Ramapuram Village, Mellachervu Mandal, Suryapet District, and found 17 blue coloured plastic cans containing 595 liters of rectified spirit. The accused, Nookala Ramasurya Prakash (A2), was present and revealed that he had rented another portion of his house to Thota Shiva Shankar (A1), who was running an illicit liquor business. A further raid was conducted on the rented portion, where Sriram Mahesh Babu (A3) was found, and contraband was seized from their possession. The petitioner was arrayed as accused No.13 for his alleged involvement in the said crime.

Heard Smt Indira, learned counsel for petitioner, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that petitioner has been falsely implicated in the crime, with no connection to the alleged offence, and was arrayed as Accused No.13 based on other accused' confessions. She asserted that petitioner is a law-abiding citizen, with no criminal record, and is willing to cooperate with the investigation. She averred that the petitioner is the GPA holder of Akshay Caps, a firm manufacturing caps for bottles, and the allegations against him are vague and baseless, created to harass him, and that the respondent-police are attempting to implicate him without evidence, and he apprehends arrest, which may damage his reputation. Therefore, while advocating that petitioner is willing to cooperate with the investigating Officer, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature, and there are several crimes registered

against the petitioner. He further submitted that the investigation is not yet completed, as such, at this stage, the question of granting bail to the petitioner would not arise. Therefore, he prayed the Court to dismiss the criminal petition. 6.

Having regard to rival submissions made and on going through the material placed on record, it is noted that petitioner is arrayed as accused No.13 alleging that he has worked hand in hand with accused Nos.1 and 2 who are prime accused. That apart, though learned Additional Public Prosecutor contended that petitioner is implicated as accused in several other crimes, it is seen that he was granted anticipatory bail in those cases. Considering the fact that the offences alleged against the petitioner are punishable for less than seven years, this Court deems it fit to grant pre-arrest bail to petitioner, subject to compliance of the following conditions:

i.

The petitioner shall surrender before the Station House Officer, the Prohibition and Excise Police Station, Huzurabad within two weeks from today, and on such surrender, the said Station House Officer shall release petitioner on bail, on him executing a personal bond for Rs.25,000/-, (Rupees

Twenty Five Thousand only), with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case. iii.

The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required. 7.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
