THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.30702 OF 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring action of the second and third respondents in not acting on petitioner's complaint dated 09-08-2015 as arbitrary, unjust, illegal and consequently direct the second and third respondents to take action against the fifth respondent and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and render justice ."

2. When the matter is called today, written instructions dated 30.09.2015, furnished by the Assistant Sub Inspector of Police, I.Polavaram Police Station, East Godavari District, have been placed on record by the learned Government Pleader for Home and the said instructions read as under:

"It is submitted that the Station House Officer, I.Polavaram police station, East Godavari District received the petitioner's complaint through the Sub Divisional Police Officer, Amalapuram on 16.8.2015 for necessary action.

In the said complaint it was mentioned that the complainant/petitioner herein acquired the land in RS.No. 149/1 and 149/7 situated at T.Kothapalli village from one Jalli Bhairaswamy @ Bhairava Murthy through Gift Deed. On 10.8.2015 the petitioner herein and others illegally occupied the said land, beat the complainant and threatened with dire consequences. The complainant requested the police to take necessary action.

It is submitted that basing on the said complaint the Station House Officer, I.Polavaram police station, East Godavari District enquired the matter and as per the letter of the Tahsildar, I.Polavaram Mandal vide Ref.No.282/2015 dated: 26.8.2045 revealed that the

above said land stands in the name of the petitioner herein. The Station House Officer, I.Polavaram police station, East Godavari District is taking steps to register a criminal case against the 5th respondent herein and others."

3. On noticing the said instructions, learned counsel for the petitioner requested this court to dispose of the writ petition by recording the written instructions.

4. In view of the above, writ petition is disposed of, by recording the written instructions dated 30.09.2015, furnished by the Assistant Sub Inspector of Police, I.Polavaram Police Station, East Godavari District.

5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 05th October, 2015 SS
