HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 1225 of 2009 Order:

The original counsel who filed the present Writ Petition expired and the name of the counsel who is on record was directed to be printed by order dated 08.11.2017. On 15.11.2017, a request was made seeking adjournment and it was made clear that if the counsel for the petitioner is absent on the next date of adjournment, the case would be decided on merits as it related to the year 2009. Today, when the case is called, none appeared for the petitioner.

The case of the petitioner is that he applied for the post of Contract Junior Lineman in the month of November 2006 in the office of the third respondent. He states that he possessed the requisite qualification as he passed SSC and ITI with Electrical Trade. He belongs to Scheduled Tribe Community. When no action was taken by the respondents, the petitioner filed W.P.No.11347 of 2007 and the said Writ Petition was allowed at the admission stage by directing the respondents to allow the petitioner for interview. The petitioner was called for interview, but his candidature was rejected by order dated 07.07.2007. Challenging the order of rejection, he filed W.P.No.16231 of 2007. The said Writ Petition was disposed of on 31.07.

2007 by directing the respondents to consider the case of the fresh contract labour after completing the appointments of the existing contract labour in respect of left over vacancies. When an order was passed on 20.11.2007 by the third respondent stating that the candidature of the petitioner would be considered along with other fresh ST candidates as per merit in terms of notification dated 08.06.2006 as revised on 20.10.2006 after getting instructions from the Corporate Office, the present Writ Petition was filed.

In view of the above, the respondents are directed to consider the case of the petitioner for appointment as Contract Junior Lineman in the vacancies that remained unfilled in respect of Scheduled Tribe Community candidates, if the petitioner is otherwise eligible, within a period of three

(3) months from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
