HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.28869 OF 2017 ORDER:

Heard learned counsel for petitioner and learned standing counsel for respondents 1 and 2.

This writ petition is filed challenging the action of the respondents 1 and 2 in shifting the examination centre from Rayachoty to Kadapa. The petitioners state that they are residents of Rayachoty Mandal, YSR Kadapa District and they are pursuing graduation/post graduation through a distance mode of education provided by respondents 1 and

2. The respondents 3 and 4 are imparting education in respect of above courses and the examinations are scheduled from 28.08.2017 onwards. They opted for Rayachoty centre at the time of paying the examination fee, but all of a sudden the centre was changed from Rayachoty to Kadapa to a distance of 60 kilometres. In those circumstances, the petitioners filed the present writ petition.

The learned standing counsel for respondents 1 and 2 submits that there are nearly 800 candidates, who opted for Rayachoty examination centre and all could not be accommodated in Rayachoty centre and hence, some of the candidates were allotted to Kadapa centre. The hall tickets were already uploaded on 22.08.2017 itself and in view of the order passed by this Court in W.P.No.28030 of 2017 on 24.08.2017, the present wit petition is filed and it is not possible for respondents 1 and 2 to accommodate the petitioners and others, who are similarly situated. She also submits that strict measures have to be taken for conducting examinations as there were allegations of malpractice and hence, more number of students could not be accommodated in one centre.

Learned counsel for petitioners submits that in view of the distance to be travelled by the candidates including the lady candidates, it would be difficult for them to concentrate on the examinations by spending nearly three to four hours in travelling. This writ petition is filed today by way of 'House Motion' and tomorrow, i.e., 27.08.2017 being Sunday, it is very difficult for respondents 1 and 2 to accommodate the left over candidates of the Rayachoty examination centre in Rayachoty centre itself. The examinations are scheduled to be commenced at 09.00 a.m., on 28.08.2017 and in view of the same, no order can be passed in the present writ petition.

The writ petition is accordingly dismissed. It is needless to observe that respondents 1 and 2 shall not repeat this type of situation in the coming examinations and to make necessary arrangements well in advance and intimate the candidates, so that the candidates shall not face any inconvenience due to change of examination centre. Consequently, miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ___________________________ A.RAMALINGESWARA RAO, J 26.08.2017 pln
