HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.385 of 2017 ORDER :
This criminal petition is filed to relax the condition imposed by the Metropolitan Sessions Judge-cum-I-Additional District and Sessions Judge, Visakhapatnam, while releasing the petitioners/A.1 and A.2 on bail for the offence punishable under Section 20(b)(1) read with 8(c) of NDPS Act in Crime No.43 of 2016 of G.Madugula Police Station, directed the petitioners to furnish fixed deposit receipts of Rs.50,000/- each to the satisfaction of the Judicial First Class Magistrate, Paderu, and also directed to furnish the attested copies of Aadhar Cards subject to verification of genuineness they shall be released with other normal conditions. Now, the contention of the petitioners/A.1 and A.2 is that the petitioners are from a tribal area, who are not in a position to furnish fixed deposits of Rs.50,000/- each.
The total quantity of contraband involved in the offence is 32 bags of Ganza, each bag weighing about 30 KGs.
It is the contention of the petitioners that imposing such onerous condition is amount to denial of bail. By taking into consideration of large quantum of contraband involved in the case, I deem it appropriate to reduce the fixed deposit receipt to Rs.25,000/- from Rs.50,000/-.
