ORDER:

By order, dated 26.07.2013, the W.P.No.2359 of 2006 was disposed of. The operative portion of the order is as under: "Considering the facts and circumstances of the case, I am of the opinion that without reference to the delay in submission of claim for sanction of grant-in-aid, the request of the petitioner for sanction of grant-in-aid for reimbursement of the amount of expenditure incurred by the petitioner for the financial years 2001-2002 and 20022003, be considered afresh taking into consideration of the report of the District Collector, Kurnool, dated 08.09.2004 and pass appropriate orders on the representation submitted by the petitioner on 18.5.2005, within a period of six (6) weeks from the date of receipt of a copy of this order."

2. Alleging that the said orders are not complied with, this contempt case is filed.

3. On behalf of the respondent, counter affidavit is filed deposed by Sri Rajesh Kumar Maura.

4. According to the averments in para 9 of the said counter affidavit, orders were passed on 31.10.2014 recommending for reimbursement of the amount of Rs.13,98,600/- to the petitioner for the expenditure incurred for

the financial years 2001-02 and 2002-03 respectively and the amount is being processed for release as soon as the funds are allocated under the relate budget in the 2nd supplementary of Financial Year 2014-15. Thus, insofar as the directions issued for passing orders, there is compliance of the directions issued by this Court. However, sofar the money is not released. Even according to the counter affidavit, the amount was to be paid as per the allocation in the 2nd supplementary period of the financial year 2014-15. By now, the 2nd supplementary period is also over.

Learned Assistant Solicitor General states that respondents require six (6) weeks time for releasing the money as already ordered.

5. Recording the same, the Contempt Case is closed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this contempt case shall stand closed. _________________ P.NAVEEN RAO, J Date: 20th February, 2015 KL
