THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4323 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in C.C.No.320 of 2015 on the file of the XIV Metropolitan Magistrate, Cyberabad, at L.B.Nagar, arising out of offences under Sections 498-A and 506 IPC read with Section 34 IPC and Section 4 of the Dowry Prohibition Act. Heard and perused the material available on record. Learned counsel for the petitioners after arguing for some time, confined his arguments with regard to dispensing with the presence of the petitioners herein.

Considering the fact that the case is arising out of matrimonial disputes and also as the question of identity of the petitioners does not arise, the presence of the petitioners herein is dispensed with except on the dates when the trial Court insists for their appearance. The petitioners shall be represented through their counsel before the Court below on all hearing dates.
