THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY PETITION No. 164 OF 2015 O R D E R:

Today, when the matter is taken up, learned counsel for the respondent company hands over to the learned counsel for the petitioner a cheque bearing No. 001402, dated 14.09.2016 drawn on HDFC Bank, Banjara Hills Branch, for a sum of Rs.7,77,513/-, towards full and final settlement of the claim made in this Company Petition. With this, the amount agreed to be paid by the respondent company stands discharged. Hence, no useful purpose would be served by keeping the Company Petition pending. The Company Petition is therefore, closed. However, it is made clear that the petitioner is at liberty to seek revival of the Company Petition if the cheque is dishonoured on the due date, apart from exercising its right under any other enactment. No costs.
