HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 11341 of 2010 ORDER:

Heard learned counsel for the petitioner and Government Pleader for Revenue.

The present writ petition came to be filed seeking a direction to respondent Nos.1 to 4 not to reduce the road from 6 meters to 4 meters in E.B.C.Colony, Chebrolu Village, Gollaprolu Mandal, East Godavari District and to allot the same to any third parties.

The averments in the affidavit file in support of the writ petition would show that the father of the petitioner was allotted plot No.365 admeasuring Ac.0.03 cents situated in Sy.No.104 of Chebrolu Village, Gollaprolu Mandal vide Ref.No.B/6/2002 dated 07.02.2002 and after that the father of the petitioner constructed a house in the said site and residing therein. While things stood thus, the V.R.O. Chebrolu, V.R.O. Durgada, Mandal Surveyor and Superintendent of the M.R.O. Office, Gollaprolu, are alleged to have measured the land in the colony before the allotment of site to the physically handicapped welfare association and send proposals to respondent Nos.1 to 3 to reduce the road from 6 meters to 4 meters and to allot the remaining site to one Smt. A.Rajaya Laxmi and Satyavathi, who are evicted from the land allotted to the physically handicapped welfare society. This action of the respondents is sought to be questioned in this writ petition.

Though various grounds are raised in the writ petition,

learned counsel for the petitioner submits that the writ petitioner shall make a fresh representation bringing to the notice of the respondents about the grievance expressed in this writ petition, in which event the same may be considered in accordance with law.

Learned Government Pleader for Revenue submits that he has no objection for the same.

Without going into the merits of the case and having regard to the circumstances stated above, the writ petition is disposed of, advising the respondents to consider the representation, if any, made by the petitioner with regard to the reduction of road margin in E.B.C.Colony, Chebrolu Village, Gollaprolu Mandal, in accordance with law, at the earliest.
