THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.39389 of 2013 ORDER:

The petitioner claims to be the absolute owner and possessor of land to an extent of Ac.1.20 guntas in Survey No.669/2 situated in Mahaboobabad Village and Mandal. He states that he purchased the said property under a registered Sale Deed on 30.03.1982 and his name was also mutated in the revenue records. The revenue authorities also issued pattadar passbooks and title deeds in his favour. He states that to the north side of said land, Government land is situated in Survey No.665 and the Government formed 80' feet wide road from railway gate to RTC bus stand at Mahaboobabad and the said road is locally known as Necklace Road. Abutting the petitioner's land when respondents 3 and 4 are claiming the land of the petitioner by taking advantage of contiguous Government land, the present Writ Petition is filed.

The petitioner also filed a representation on 22.11.2013 to the third respondent for survey of the land.

Even after five years, no counter-affidavit is filed by the third respondent.

In the circumstances, this Writ Petition is disposed of directing the third respondent to consider the representation of the petitioner, dated 22.11.2013 and pass appropriate orders, in accordance with law, within a period of three months from the date of receipt of a copy of this order.
