M/S Nazma Chillies Exports And Commission Agents v. The State Of A.P.

THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.31616 of 2018 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief/s:

"...to issue any writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 4th & 5th respondents in not processing the renewal application of the petitioner firm dated 19-05-2018 for renewal of the license bearing No. CI 01254 for further period from 2018 to 2023 without any reason/objections as illegal and arbitrary and consequently direct the 4th & 5th respondents to consider and process the above said application and renew the license in favour of the petitioner firm and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." I have heard the submissions of Sri Raja Reddy Koneti, learned counsel for the petitioner, and of the learned Standing Counsel appearing for the respondents 4 and 5. The grievance of the petitioner is that he had applied for renewal of license, on 19.05.2018, for a further period from 2018 to 2023, but, the respondents concerned have not passed any orders thereon.

Learned Standing Counsel submits that the respondents concerned will dispose of the said application within four weeks. In the result, the Writ Petition is disposed of directing the respondents concerned to take a decision, in accord with law, on the application, dated 19.05.2018, of the petitioner within four weeks from the date of receipt of a copy of this order and

communicate the decision thereon to the petitioner within a week thereafter.

As a sequel, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
