THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL REVISION PETITION No.4857 of 2017 ORDER:

This petition is filed under Article 227 of the Constitution of India by the petitioners challenging the orders dated 08.09.2017 in I.A.No.200 of 2017 in I.A.No.169 of 2013 in O.S.No.244 of 2013 on the file of the Court of Sub Divisional Magistrate & Special Assistant Agent to Government, Mobile Court, Bhadrachalam.

A perusal of the record reveals that the petitioner filed I.A.No.200 of 2017 in I.A.No.169 of 2013 in O.S.No.244 of 2013 seeking police aid and the trial Court ordered that petition by order dated 08.09.2017. However, a perusal of the record further reveals that on contest by the respondents, the trial Court dismissed the main I.A.No.169 of 2013 filed by the petitioner seeking temporary injunction, on 29.11.2016. Further, challenging the order dated 29.11.2016 passed in I.A.No.169 of 2013, the respondent herein filed CRP No.6175 of 2017 and the same was disposed of by this Court with certain directions to the trial Court. In that view of the matter, the order dated 08.09.2017 in I.A.No.200 of 2017 is non-est in the eye of law and hence the same is hereby set aside.

Hence, in view of the observations made by this Court in Civil Revision Petition No.6175 of 2017, this Court is of the considered view that no orders need be passed in this Civil Revision Petition. Accordingly, the C.R.P. is disposed of. As a sequel, the miscellaneous petitions, pending if any, shall stand closed. _________________________ T.SUNIL CHOWDARY, J 6th October 2017 Rns
