THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.8471 of 2017 ORDER :

Petitioner claims that he was promoted as Assistant Motor Vehicle Inspector in the year 2010 and he is fully qualified and eligible for promotion as Motor Vehicle Inspector. Infact by July 2013 itself, he was eligible, but erroneously, he was not considered. Aggrieved by his non-consideration for promotion, on 05.11.2013, a representation was made. But the same is not so far acted upon and even now his claim is not considered and on the contrary promotions are affected on 06.01.2017 ignoring the petitioner.

Reasons for not considering the claim of the petitioner are not forthcoming. According to the petitioner the grievance ventilated in the representation dated 05.11.2013 is yet to be examined and suitable decision is not made and communicated to the petitioner keeping the issue in dark.

Having regard to the fact that a claim is already made, as early as on 05.11.2013, the Writ Petition is disposed of, without expressing any opinion on merits, directing the Transport Commissioner (1st respondent) to examine the claim of the petitioner for eligibility for promotion as Motor Vehicle Inspector and pass orders as warranted by law, by assigning due reasons in support of his decision and communicate the same to the petitioner. A decision to this effect shall be taken as expeditiously as possible, preferably within a period of two (2) months from the

date of receipt of copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
