HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE Dr. JUSTICE SHAMEEM AKTHER WRIT PETITION NO.11491 OF 2017 ORDER: (per Hon'ble the Acting Chief Justice Ramesh Ranganathan) It is brought to our notice that the petitioner herein, in his capacity as the President of the Tandur Citizens Welfare Society, had filed Application No.195 of 2016 before the National Green Tribunal ("NGT" for short), Southern Zone at Chennai on the very same issues which he has raised in the present Writ Petition; and the said application was dismissed for non-prosecution by order of the NGT dated 04.01.2017.
Sri T.V. Ramana Rao, Learned Standing Counsel for the Pollution Control Board, on instructions, states that a restoration application has been filed before the NGT which is slated for hearing on 12.05.2017. As the final relief sought for in the application before the NGT and the Writ Petition filed before this Court is the same; and as the petitioner herein had failed to disclose the fact that he had approached the NGT albeit in his capacity as the President of the society, we see no reason to entertain this petition. Suffice it to make it clear that the NGT shall examine the petitioner's application on its merits uninfluenced by the dismissal of the present Writ Petition. The Writ Petition is disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed.
