HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.2036 of 2014 ORDER:
The matter is listed at the instance of the respondentCorporation seeking to vacate the interim order of this Court dated 28.01.2014.
Counter-affidavit is filed.
With the consent of the parties, Writ Petition itself is being disposed of, as the matter is of simple nature. According to the petitioners, they are licencees of stalls in the premises of Guntur main Bus Station, wherein they are selling popcorn. On account of agitation for separate statehood, i.e. "Samaikya Andhra" agitation, business of the petitioners was affected to large extent. As the petitioners' business is affected and if the licence fee which was agreed to be paid on earlier occasion and the likely business that may be generated based on the traffic inflow, was taken into consideration, there being disruption on account of the agitation, petitioners' case is entitled to be considered for remission of the licence fee for the said period.
On the other hand, learned standing counsel for the respondent-Corporation opposes the Writ Petition and submits that Writ Petition of the nature does not lie and the relief of the nature which the petitioner is seeking cannot be granted as the same is governed by the terms of the deed of licence entered into between the petitioners and the respondent-Corporation. However, learned
CKR, J W.P.No.2036 of 2014 standing counsel would submit that if there is any grievance, it is always open for the petitioners to approach the competent authority, who shall consider the same in accordance with law and subject to the terms of the agreement.
Having considered the respective submissions, without expressing any opinion on the merits of the matter, Writ Petition can be disposed of with a direction to the respondents-authorities to consider the representation said to have been filed by the petitioners on 05.11.2013 and dispose of the same within a period of eight (8) weeks from the date of receipt of this order. Till the disposal of the representation, no coercive steps shall be taken against the petitioners. Writ Petition is accordingly disposed of. No order as to costs. As a sequel to disposal of the Writ Petition, miscellaneous petitions, if any pending in the Writ Petition, shall stand closed. __________________________ CHALLA KODANDA RAM, J January 3, 2017 MRR
