HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 20872 of 2015 ORAL ORDER:
Heard learned counsel for petitioner, learned Government Pleader for Municipal Administration and Sri P Keshav Rao, learned standing counsel for GHMC-2nd respondent.
2. This writ petition is filed questioning the action of the second respondent in interfering with the peaceful possession of the petitioner's property bearing House No. 40-44/4, Jawaharnagar, Moulaali, Hyderabad without following due process of law.
3. Petitioner claims to be owner and possessor of the subject house and residing therein and regularly paying property tax. The petitioner alleges that second respondent without issuing any notice or following due process of law illegally interfering with his possession and insisting to vacate the premises.
4. Mr.P Keshav Rao, learned standing counsel for GHMC submits that on mere apprehension petitioner has filed the present writ petition.
5. Admittedly, petitioner has not made any representation or complaint to the authorities concerned and straightaway rushed to this Court.
6. Having regard to the same, without expressing any opinion on the merits of the matter, the writ petition is disposed of granting liberty to petitioner to make a representation to the Deputy Commissioner, Greater Hyderabad Municipal Corporation, Malkajgiri (2nd respondent) ventilating his grievance with supporting documents. On receipt of such representation, the 2nd respondent shall consider and pass appropriate orders as warranted by law. It is needless to observe that the respondents shall not interfere with the possession of the petitioner in the subject property except by following due process of law. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
