HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.C.M.P.No.741 of 2012 ORDER:

This petition is filed to withdraw O.P.No.1249 of 2011 from the file of Family Court, Ranga Reddy District at L.B. Nagar and transfer the same to Senior Civil Judge, Jangaon, Warangal District.

2. Wife filed this petition on the ground that she has no means to attend Family Court, Ranga Reddy from Jangaon and that she got a small child and on the ground of her convenience, she sought transfer of O.P.No.1249 of 2011 from Family Court, Ranga Reddy to Senior Civil Judge, Jangaon, Warangal District.

3. Husband resisted the application mainly on the ground that he has life threat at Jangaon and he was injured when he attended Jangaon Court in connection of 498-A case and that Magistrate also granted protection order to the husband.

4. Both sides submitted their arguments supporting the respective contentions of both parties. Though counter is filed along with photographs showing the injuries, no reply affidavit is filed on behalf of wife disputing those averments. 5.

Considering these aspects, without going into the correctness of contentions and rival contentions of both parties, I feel that this application can be disposed of by directing the Family court, Ranga Reddy to dispense with the presence of wife for each and every adjournment and dispose of O.P. within a stipulated time.

6. For these reasons, Family Court, Ranga Reddy is

directed to dispense with the presence of wife/petitioner for each and every adjournment. However, she shall appear as and when her personal appearance is felt necessary by the Court. Family Court, Ranga Reddy shall dispose of O.P No.1249 of 2011 within four (04) months from the date of receipt of a copy of this order.

7. Accordingly, this Transfer Civil Miscellaneous Petition is disposed. No costs. Miscellaneous Petitions, pending in this petition, if any, shall stand closed.
