O.S.No.

22 of 2009 was filed by the first respondent herein seeking declaration of title and for recovery of possession of the suit schedule property by evicting defendants 4 to 45. The appellants-defendants 4 to 45 were set ex parte in the suit. Sri S.Chalapathi Rao, learned counsel for the appellants, would submit that, though a petition was filed to set aside the ex parte order, the Court below returned the petition, filed by the appellants herein (defendants 4 to 45 in the suit), on the ground that, since judgment has already been passed on merits, the application to set aside the ​ex parte order was not maintainable.

In the judgment under appeal, the Court below has specifically recorded that the names of the defendants 4 to 45 have been shown as possessors in respect of the suit schedule property; and they remained in possession of the suit schedule lands from 1955-56 onwards. The suit was decreed, the first respondent was declared to be the owner of the suit schedule property, and was held entitled to recover possession of the suit schedule property by evicting defendants 4 to 45 (appellants herein) therefrom. As the judgment under appeal itself records that the appellants have been in possession of the suit schedule lands, and are cultivating the same, for the past nearly half a century, we were initially inclined to grant stay. Dr.

Venkat Reddy Donthi Reddy, learned counsel for the first respondent (plaintiff in the suit), would submit that, instead of granting stay and keeping the appeal pending on the file of this Court, this Court may, instead, set aside the judgment imposing costs on the appellants, and fix a time frame within which the suit should be heard and decided by the Court below. Sri S.Chalapathi Rao, learned counsel for the appellants, while readily agreeing for such an order being passed, would however contend that the appellants, being small and marginal farmers, should not be mulcted with costs. It is evident from the judgment under appeal that the appellants herein were set ex parte, and did not contest the suit on merits. As they are small and marginal farmers, we consider it appropriate to impose costs of Rs.

500/- (rupees five hundred only) on each of the appellants who shall pay the said sum to the first respondent within six weeks from today. On payment of costs, the suit shall stand restored to file, and the Court below shall decide the suit at the earliest and with utmost expedition. The judgment and decree, under challenge in this appeal, are set aside and the matter is remanded to the Court below for adjudication of the suit afresh, and in accordance with law. The Appeal Suit is allowed to the extent indicated hereinabove on payment of costs as aforementioned.
