HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 6276 of 2011 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue (TG).

With the consent of both the parties, the writ petition is disposed of at the admission stage itself.

The present writ petition is filed to declare the inaction of respondent Nos.2 and 3 in entering the names of the writ petitioner and his brothers namely Yedula Hanmanth Reddy, Yedula Mohan Reddy and Yedula Eswar Reddy in the revenue records as pattadars of land to an extent of Ac.17.28 gts., situated in Sy.No.650 of Veepangandla Village and Mandal, Mahaboobnagar District, as arbitrary, illegal, unjust, unconstitutional and violative of principles of natural justice. The averments in the writ petition are as under: The ancestors of the petitioner acquired dry land to an extent of Ac.17.28 gts., situated in sy.No.650 of Veepangandle Village and Mandal and since last 70 years the ancestors of the petitioner are in enjoyment of the said property without any claim or interruption.

While things stood thus, the Government started claiming ownership of the land. At that stage, the father of the petitioner along with the elder brother of the petitioner filed O.S.No.53 of 1981 before the Court of Junior Civil Judge, Kollapur, seeking declaration of title and perpetual injunction against the government and third parties.

the said suit was decreed in favour of the father of the petitioner. After the death of the father of the writ petitioner, the petitioner and his brothers are in possession and enjoyment of the said property.

It is stated that the petitioner herein along with his family members made representations dated 10.06.2004, 30.10.2004, 13.10.2006 and January, 2010, requesting the respondents herein to mutate their names in the revenue records basing on the decree, but the respondents did not take any action till date. Hence, the petitioners approached this Court by filing the present writ petition.

The only grievance of the petitioner is that though he along with his brothers made the representations on 10.06.2004, 30.10.2004, 13.10.2006 and January, 2010, till date the same are not being disposed of.

Having regard to the circumstances stated above and without going into the merits of the case, the writ petition is disposed of by directing the third respondent to dispose of any of the representations dated 10.06.2004, 30.10.2014, 13.10.2006 and January, 2010, if any pending, in accordance with law within a period of eight (08) weeks from the date of receipt of a copy of this order. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
