THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.9767 OF 2016

O R D E R

The prayer of the petitioners in this case is as under: 'For the reasons stated in the accompanying affidavit the petitioners pray that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of 3rd respondent in insisting the petitioners to yield and settle to the terms of 4th respondent connected to civil disputes pending between 4th respondent on one hand and the petitioners on the other, in O.S. No. 1542 of 2015 on the file of the court of Learned VI Addl. Senior Civil Judge, Visakhapatnam, as illegal, irregular, irrational, without any authority of law and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents not to interfere in any manner with the petitioners' personal liberty and properties and said civil disputes and pass such other orders or order as this Hon'ble Court may deem fit and proper in the circumstances of the case.'

Written instructions dated 01.04.2016 were furnished by the Inspector of Police, Maharanipet Police Station, Visakhapatnam City, to the office of the learned Government Pleader for Home, wherein he denied the allegation of the petitioners that the police authorities called them to the police station for settling their civil disputes with the fourth respondent. The Inspector categorically stated that the police authorities never called the petitioners and that the petitioners never came to the police station.

In the light of the categorical denial by the police authorities, which is duly taken on record, no adjudication is warranted on merits in the present case.

Sri Naresh Kumar, learned counsel representing Sri Nimmagadda Satyanarayana, learned counsel for the petitioners, is also agreeable to closure of the case recording the stand of the police authorities.

The writ petition is accordingly closed. Pending miscellaneous petitions shall also stand closed in the light of this final order. No order as to costs.
