THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION Nos.9321, 9323, 9325 AND 9329 OF 2018 COMMON ORDER:

In all these Criminal Petitions, the petitioner challenged the order, dated 07.08.2018, passed in Crl.M.P. Nos.1467, 1468, 1469 and 1466 of 2018 in C.C. Nos.17, 18, 23 of 2017 and 63 of 2017, respectively, by the learned III Additional Judicial Magistrate of First Class, Khammam, whereby and where-under, the petitions filed by the petitioner under Section 317 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C."), were dismissed and issued Non-bailable Warrant against it. Though the petitioners approached the Court below under Section 317 of Cr.P.C. and the same are pending, but requested this Court to set aside the order, dated 07.08.2018, passed in Crl.M.P. Nos.1467, 1468, 1469 and 1466 of 2018 in C.C. Nos.17, 18, 23 of 2017 and 63 of 2017, respectively, on various grounds.

At the stage of arguments, learned counsel for the petitioner requested to permit the petitioner to appear before the Court below and direct the Court below to consider the applications on the same day. In view of the request made by the learned counsel for the petitioner, the petitioner is permitted to appear before the Court below on the date fixed by the Court and on his appearance, the Court below is directed to dispose of the applications on the same day following the principle laid down by the Hon'ble Supreme Court in M/s. Bhaskar

MSM,J Crl.P.Nos.9321, 9323, 9325 & 9329 OF 2018 Industries Ltd. v. M/s. Bhivani Denim and Apparels Ltd. and others1.

With the above direction, all these Criminal Petitions are disposed of, at the stage of admission itself. No order as to costs. Consequently, miscellaneous petitions, if any, pending in these Criminal Petitions, shall stand dismissed.
