THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.4092 of 2010 ORDER:

This Writ Petition was filed by four petitioners challenging the action of the respondents in not considering their case for appointment as contract Junior Lineman along with other similarly placed contract labour.

Now a counter affidavit is filed stating that pursuant to the interim direction, a pole climbing test was conducted and in the said test the first petitioner failed. Petitioner Nos.3 and 4 are having ITI qualification in Diesel Mechanic Trade and ITI Machinist Trade respectively. But, as they are not having experience certificates, they could not be considered. However, in respect of petitioner No.2, he possessed experience certificate and also succeeded in the pole climbing test. Accordingly, he was included in the selection list. Out of 302 posts notified, 291 vacancies were filled up with the eligible experienced contract labour. It was further stated in the counter affidavit that petitioner No.2 would be examined and considered in the left over vacancies as per eligibility and rule of reservation. It was also stated that when a Memo dated 20.03.2010 was issued for accommodating the selected persons, the same was stayed by this Court in W.P.No.6981 of 2010 and batch on 26.03.2010.

Today when the case is taken up for consideration after adjourning from 06.04.2016, learned Counsel for the petitioners submits that petitioner No.2 was not in contact with him. But, in view of the averments made in the counter affidavit of the respondents, it is assumed that appropriate action was taken by the respondents in respect of petitioner No.2, who was placed in the selection list. In view of the above, recording the averments made in the counter affidavit, this Writ Petition is closed. The miscellaneous petitions

pending, if any, shall also stand closed. There shall be no order as to costs.
