THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.27694 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

This writ petition is filed challenging the action of the respondents in not releasing the bank guarantee of Rs.29,652/- and seizing stocks of 230 quintals of rice, as per the orders of the Court of the District & Sessions Judge, Krishna at Machilipatnam in E.C.Appeal No.38 of 2012 dated 31.05.2013.

The learned Government Pleader, on the basis of written instructions dated 05.09.2015, submits that the Tahsildar, Jaggaiahpeta was authorized to draw an amount of Rs.29,652/-covered by challan bearing No.7576 dated 22.10.2010 and refund the same to the owner of the seized stock, the petitioner, under a proper acknowledgment vide proceedings of the second respondent dated 01.09.2015.

4. In view of the same, the writ petition has become infructuous and the same is accordingly dismissed as infructuous. No order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
