HON'BLE SRI JUSTICE S.V.BHATT W.P.No.1943 OF 2015 ORDER:
The petitioners pray for Mandamus declaring Award No.AA/851/2013 dated 31.10.2014 passed by the 3rd respondent, as illegal and contrary to the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
Upon instructions, the learned Government Pleader submits that the Award impugned in the writ petition is dated 31.10.2014 and also passed under the Land Acquisition Act, 1894. On examination of record, it is further stated that the cause complained in the writ petition is covered by the decision of this Court in W.P.No.29913 of 2014 and batch.
By adopting the reasons stated in the order dated 02.12.2014 in W.P.No.29913 of 2014 and batch, the impugned Award is set aside and the writ petition is allowed. There shall be no order as to costs. It is needless to observe that the respondents are at liberty to proceed further in pending acquisition proceedings in accordance with Section 24 of the Act.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
